In terms of the BGB (i.e. the German Civil Code) the term "Gefahrübergang" is correct but not the term "Gefahrenübergang" although the latter one is often erroneously used on the Web, in particular in German-speaking T&Cs (in Germany AGB called).

In my humble opinion, many German T&Cs addressed to the German end customer contain ineffective clauses regarding the transfer of risk and the ordering of consumer goods via the Web.

Citation from Besonderheiten im Kaufrecht stated in the German edition of Wikipedia – the free encyclopedia:

"Beim Versendungskauf findet der Gefahrübergang bereits dann statt, wenn die Sache abgeschickt wurde (§ 447 Abs. 1 BGB), also z. B. mit der Übergabe an den Spediteur.
